Welcome to 3DMotion.Art (“we,” “our,” or “us”), a platform offering customizable 3D motion video creation tools. By accessing or using our website and services (the “Service”), you (“you,” “your,” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. Agreement to Terms

By using the Service, you confirm that you are at least 16 years old or have the legal capacity to enter into this agreement. You agree to comply with these Terms and all applicable laws and regulations.

2. Service Description

The Service enables users to generate downloadable video files by customizing 3D motion templates using an in-browser editor. You may select a template, customize its content (text, images, layout, etc.), and generate a video directly within your web browser. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts

  • Account Creation: Some features require registration. You must provide accurate and complete information and maintain the confidentiality of your credentials.
  • Account Responsibility: You are solely responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access or security breach.
  • Account Suspension: We reserve the right to suspend or terminate your account at any time for violations of these Terms, including misuse or non-payment.

4. User Content

  • Ownership: You retain full ownership of any content you upload, including text, images, and designs (“User Content”).
  • Responsibility: You are solely responsible for ensuring that your User Content complies with all applicable laws, including those governing copyright, trademark, and other intellectual property rights. We do not accept liability for any User Content you upload.
  • License to Us: You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and adapt your User Content solely as necessary to operate and improve the Service.

5. Intellectual Property

  • Ownership: All templates, 3D assets, animations, software, and tools provided as part of the Service are owned by us or our licensors and are protected by intellectual property laws.
  • License to You: We grant you a limited, non-exclusive, non-transferable license to use the Service to generate video files for personal or commercial use in your own creative projects, subject to these Terms.
  • Usage Restrictions: You may not sell, redistribute, sublicense, or offer generated videos for resale — whether on marketplaces or elsewhere — unless the videos have been substantially modified to constitute original derivative works.
  • Prohibited Use: You may not copy, modify, reverse-engineer, or distribute any part of the Service or its components unless expressly permitted by us.

6. Payments and Credits

  • Credit System: The Service operates on a prepaid credit system. Users must purchase credit packs, which are deducted as videos are generated based on pricing listed on our site.
  • Non-Refundable and Non-Transferable: All purchased credits are non-refundable and non-transferable. This includes cases of accidental purchase, non-use, account suspension, or termination for Terms violations.
  • Pricing and Taxes: Pricing for credit packs and generation costs are displayed on our website and may be updated at any time. You are responsible for all applicable taxes.
  • Forfeiture: In the event of a Terms violation or account suspension/termination, any remaining credits in your account may be forfeited without compensation.

7. Prohibited Conduct

You agree not to:

  • Use the Service for unlawful or harmful purposes.
  • Upload or share content that is offensive, defamatory, harassing, hateful, pornographic, or infringing on the rights of others.
  • Interfere with or disrupt the Service, including attempting to hack, reverse-engineer, or overload our systems.
  • Create or distribute content that promotes violence, discrimination, or harm.

8. Termination

We may suspend or terminate your access to the Service, with or without notice, for violations of these Terms or other misconduct. Upon termination:

  • Your right to use the Service ends immediately.
  • Any remaining credits in your account may be forfeited.
  • You must continue to comply with Section 5 regarding the use of previously downloaded videos.

9. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities.

We are not responsible for:

  • The user's failure to read or understand our FAQ section or provided documentation.
  • Misunderstandings regarding what is included in a generated video.
  • Incompatibility between our video output formats and the user's software, devices, or editing workflow.
  • Any assumptions the user makes about the Service that are not explicitly stated on our website.

Our total liability for any claim related to the use of the Service shall not exceed the value of unused credits in your account at the time the issue arises.

11. Indemnification

You agree to indemnify, defend, and hold harmless 3DMotion.Art, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any legal dispute arising out of or relating to these Terms or your use of the Service.

13. Changes to Terms

We reserve the right to modify or update these Terms at any time. When we make material changes, we will post the updated Terms on our website. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
